1. Terms and conditions of use of the site

The use of the site “https://clinicaltrials.servier.com” (hereinafter referred to as “Site”) is subject to acceptance of the Terms and Conditions of Use (hereinafter referred to as “TCU”).

Using the Site, the User (hereinafter referred to as “User”) acknowledges that he has read these TCU, declares that he accepts them without reservation and commits to respecting them. Their content may change, so we invite the User to consult them on a regular basis.

2. Scope

In this Site, INSTITUT DE RECHERCHES INTERNATIONALES SERVIER (hereinafter referred to as “SERVIER”) provides clinical data and scientific information arising out its clinicaltrials information (in the field of human health), in accordance with specific legal and regulatory obligations that apply to pharmaceutical companies of pharmaceutical industries, namely the provisions of the French Public Health Code.

It is however specified that the Site does not constitute a medical or telemedicine device. As a result, the information provided on the Site cannot be considered as medical advice or diagnosis, nor does replace a medical consultation with a health professional.

Similarly, this information shall not be interpreted as the promotion or advertising of products, whether they are marketed or not by LES LABORATOIRES SERVIER or the legal entities of its Group. For any information concerning any of these products, Users are invited to contact directly the legal entity that holds the marketing authorization (MA) for the product concerned.

You further acknowledge having been informed that the present Site is accessible 24 hours a day and 7 days a week, except in case of force majeure events, computer difficulties, difficulties linked to the telecommunications networks structure or technical difficulties.

It is specified that INSTITUT DE RECHERCHE INTERNATIONALES SERVIER and LES LABORATOIRES SERVIER are affiliated companies within the Servier Group.

The Site may contain information the nature and form of which is not suitable for consultation by a minor.

3. Intellectual property

The User acknowledges that all the content available on the Site, including non-limited texts, graphics, photographs, drawings, data, images, audio and video, but also the Site’s tree, its navigation, its logos, the design and organization of its sections, their titles, databases, their structure and their contents, the trademarks (hereafter referred to as “The Content”) are the exclusive property of SERVIER and/or are owned by third parties and are the subject, when required, of an authorization for the use to SERVIER and/or its affiliates by their owners. Such Content is protected by intellectual property law or by the provisions relating to image rights.

Only copying for private use is authorized in accordance with the French Intellectual Property Code.

Therefore, any commercial exploitation, representation, distribution, reproduction, adaptation, translation, transformation, total or partial, by any process whatsoever, of the Site and/or its components, any sharing of the Site Content as well as any transfer to another website without the prior written authorisation of the Legal Entity are strictly prohibited, in accordance with the provisions of article L.122-4 of the French Intellectual Property Code.

The Content can only be used by the User for personal information and within the strict limits of the use of the Site in accordance with these TCU. Any other form of use of Content by any process, without prior and express authorization of SERVIER, is prohibited and would constitute infringement.

In addition, the trademarks and logos on the site are registered trademarks. Any full or partial reproduction of these trademarks or logos, made from the elements of the Site without the prior and express permission of its owner is prohibited.

5. Use of the site

5.1. Use compliance of the Site

The User agrees to use the Site:

  • in accordance with its destination;
  • for personal use, it cannot be used for the benefit of a company or any other organization, or for professional, promotional, marketing or commercial purposes, unless otherwise stipulated;
  • respecting copyright and any other type of intellectual property rights;
  • without implementing a robot or any other automated means to access and use the Site’s content, and without attempting to obstruct the Site;
  • without attempting to copy it, reproduce it in whole or in part, make it accessible or disseminate it by any means to unauthorized third parties

The Site is freely accessible to all users but the creation of an account is required to submit a research proposal to Servier.

It is reminded that it is the responsibility of each User of the Site to take all appropriate measures to protect and secure his or her own data and/or software from any intrusion or contamination by any viruses circulating on the Internet.

5.2. Accuracy and completeness of the information on the Site

All information provided to Users on the Site is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement.

SERVIER makes every effort to ensure, to the best of its ability, the accuracy and updating of the information on the Site, at the time it is put online.

However, it in no way guarantees the truthfulness, completeness, accuracy or exhaustiveness of the information and content made available to Users on the Site and reserves the right to modify or correct, at any time and without notice, the content of the information and documents published on the Site.

In fact, SERVIER declines all responsibility for any imprecision, inaccuracy, omission or modification concerning the information available on the Site, in particular in the event of changes in regulatory or legal provisions, as well as for any damage resulting from fraudulent intrusion by a third party, in particular when it could lead to a modification of the information made available on the Site.

In this respect, SERVIER shall not be held liable for the content of these pages and the use that may be made of them by the User, namely for any direct or indirect damage caused by access or use of the Site by any person or by the impossibility of accessing it.

5.3. Modification of the Site

SERVIER reserves the right to modify the content of the Site and the data or information accessible via the Site as well as the present TCU, in particular in order to comply with any new standard, legislation and/or regulation applicable and/or to improve the performance of the Site.

In this case, the modified TCU will come into force as of the date they are put online.

It is therefore recommended that the User keeps himself/herself regularly informed of the TCU of the Site.

5.4. Availability of the Site

SERVIER endeavors to keep the Site accessible to Users 24 hours a day and 7 days a week.

However, SERVIER cannot guarantee the permanent availability and accessibility of the Site.

As such, SERVIER reserves the right to terminate, restrict, suspend or temporarily interrupt partial or total access to the Site, its functionalities, or all or part of the services offered on the Site, at any time, without notice or compensation, for any reason whatsoever and in particular for technical maintenance reasons, in the event of the occurrence of an event of force majeure or fortuitous event, computer problems, difficulties related to the structure of communication networks or any other technical difficulties.

Notwithstanding all the means implemented by SERVIER and its technical service providers, the User is informed of the lack of reliability of the Internet network, especially in terms of relative security in the transmission of data, non guaranteed continuity of access to the Site, non guaranteed performance in terms of volume and speed of data transmission and the spread of viruses. It is also specified that the Internet network and the computer and telecommunications systems are not free of errors and that interruptions and breakdowns may occur.

Consequently, SERVIER does not provide any guarantee in this respect and therefore cannot be held liable for any damage inherent in the said uses of the Internet network and the computer and telecommunications systems, in particular but without this list being exhaustive:

  • the improper transmission and/or reception of any data and/or information on the Internet ;
  • external intrusion or the presence of computer viruses;
  • the failure of any receiving equipment or communication lines;
  • any other malfunction of the Internet network preventing the proper functioning of the Site.

Furthermore, information provided on the Site are non-contractual and cannot be considered as offers of services or products.

It does not in any way constitute an assertion, guarantee or commitment on the part of SERVIER concerning the products and services presented on the Site.

SERVIER cannot be held responsible for any decision taken on the basis of information contained on the Site, nor for the use that may be made of it by third parties.

6. Responsibility

6.1. Liability of SERVIER

SERVIER shall not be held liable for any direct or indirect damage, such as, without this list being exhaustive, any loss or corruption of data, loss of programs, profits, exploitation, suffered by a User or any third party, resulting from access to the Site, navigation on the Site, the content of the Site, the use of the Site and the sites linked to it, or the impossibility to use the content, information and services offered via the Site by Users.

In particular, SERVIER declines all responsibility for damages of any nature whatsoever resulting:

  • a typographical or layout error, imprecision, inaccuracy or omission on the information accessible on the Site ;
  • a fraudulent intrusion of a third party, having led to a modification of the information, documents or elements made available on the Site;
  • the access of anyone to the Site or the impossibility to access it;
  • the failure, malfunction or incompatibility of the User’s computer equipment;
  • of an interruption of the access networks to the Site, of total or partial unavailability of the Site resulting in particular from the telecommunications operation;
  • the dissemination or introduction of computer viruses, Trojan horses, worms, via the Site and likely to affect the User’s computer equipment;
  • the credit given to any information coming directly or indirectly from the Site, from its use or from the use of a product to which it refers.

SERVIER declines all responsibility, express or implicit, if the use of the information on the Site contravenes a patent, copyright or trademark.

In any case, the User acknowledges that the information and services offered on the Site:

  • may be discontinued for cases of force majeure or beyond the control of SERVIER or facts not within the responsibility of SERVIER;
  • may contain errors of a technical or human nature;
  • may lead to one-off data losses

6.1. Liability of the User

In the event that the User disseminates content on the Site, of any nature whatsoever, the User undertakes, under penalty of liability, not to engage in any behaviour or comments contrary to the law, public order and morality, of an abusive, defamatory or discriminatory nature, threatening a person or group of persons, violating the provisions of copyright, the right to image, the privacy of others, medical secrecy or correspondence.

In general, the User undertakes to adopt a respectful behaviour, in particular with regard to other members of the Site.

The User is informed that in the event of a request from the competent authorities, SERVIER is authorized to transmit any connection data allowing the identification of the User if the latter appears to be at the origin of an illicit content or behaviour.

The User using the Application may not set up hypertext links into it.

9. General provisions

SERVIER reserves the right to amend the provisions of these TCUs. By continuing to use this site and browse, the User accepts any changes that would have occurred. Should one or more of the provisions of these TCU be struck down for any cause, the other provisions will remain full force and scope.

These TCU are governed by French law, for substantive rules and rules of form.
